§ 21.051. Discrimination by Employer







An employer commits an unlawful employment practice if because of race, color, disability, religion, sex, national origin, or age the employer:







(1) fails or refuses to hire an individual, discharges an individual, or discriminates in any other manner against an individual in connection with compensation or the terms, conditions, or privileges of employment; or




This might be too weak, but it's a catch all phrase.



There are usually law firms in your area that will do a free "intake" with you. They'll usually budget you 20 minutes, but they'll write down the info that you provide them and then review the law and decide if they think there's a case or not. Start looking in your phone book for law firms that specialize in discrimination and/or labor laws. That's your best route.

Discrimintation might not be the route to take. Family Disability act....Now maybe that is place to start.

He was found NOT GUILTY in criminal court, yet was still found guilty in civil court to the tune of millions. Frankly, having been tried and found not guilty once should be a good enough defence, but obviously not the case.



Walking in the door and being fired immediately after being in the hospital for a week should be enough to prevent it from being thrown out, and once you get in front of a jury you WILL be awarded something. I don't think this is a 'discrimination' case, there should be something different for this situation.



We had a case here a few years ago when a woman drove home drunk from an office party. She crashed, and sued her employers and won $400,000. They did everything but physically tear the keys out of her hands, but because juries seem to always see it as the little guy VS the big corporation, she won. Insane.
